The Tax Department's e-file mandate requires tax preparers tp e-file their clients' tax returns.  For calendar year 2010, you must e-file if you:
   • Prepared more than 100 original individual, partnership, and/or fiduciary income tex returns in calendar year 2009; and

   • Use tax software to prepare one or more of these tax returns in 2010.

What's covered

For the 2010 processing season, all returns and extensions must be e-filed:

Returns: electronically file all individual, partnership, and fiduciary tax returns

New for 2010 - the mandate applies to fiduciary returns

Extensions: electronically file all request for individual and partnership extensions

New for 2010 - the mandate applies to all extensions, even those with a balance due
                   - Form IT-370, Application for Automatic Six-Month Extension of Time to File for Individuals, is no longer exempt from the mandate

Business tax e-file mandate:  You may also be subject to the business tax e-file mandate, which requires e-file for:

   • corporation tax returns and extensions; and
   • all monthly sales rax returns (Forms ST-809 and St-910) and PrompTax sales tax returns (beginning with the sales tax return due April 20, 2010)
